Britney Spears' father fights back against a conservatorship removal petition, alleging she is'mentally sick.'

Britney Spears' father has rejected attempts to have him removed from the conservatorship that oversees the singer's finances and activities, claiming that there are "no grounds whatsoever" for doing so and labeling Britney "mentally unwell."

According to court filings filed in Los Angeles on Friday, Montgomery had called Spears last month, distraught, asking his aid with his daughter's mental health issues.

In response, Montgomery and her counsel claimed that Spears'misrepresented and manipulated' the call in order to benefit himself.

Britney's former bodyguard claimed she is living "like an inmate in a golden prison," with her phone calls being monitored and her ability to leave the house unattended.

Spears' motion came in response to court papers filed a day earlier by Britney's new attorney Matthew Rosengart, who asked for an emergency hearing to remove him from the conservatorship as soon as possible.

Unless the judge agrees Rosengart's request to hold a hearing sooner, a hearing to address Rosengart's motion to remove James Spears is set for September 29.

Britney Spears has been in a conservatorship since 2008, when her father petitioned the court for legal power over his daughter's life due to worries about her mental health.
